Divorce

 

 

As a matter of law, you must have been married for more than 12 months before you can apply to the court for a decree of absolute (divorce certificate).

 

You must also prove to the court that your marriage has irretrievably broken down based on any of the following five grounds. 

 

1. Your spouse has committed adultery.

2. Your spouse has behaved in a way that it is unreasonable for you stay married

3. You have been separated for 2 yrs and your spouse consents to a divorce.

4. You have been separated for 5 yrs (consent not needed).

5. Your spouse has deserted you for a period of 5 years.

 

The appropriate ground for divorce and the particulars in support must be presented in a Petition in order to start the proceedings.

 

You will need the original of your marriage certificate.

 

There is a fee for filing the Petition. However, you may be exempt from paying the fee if you are unemployed and in receipt of public assistance.
